Policies

Our policies help us maintain quality collections, services and safe environments.

The Judge Ben C. Green Law Library serves the education and research needs of its students, faculty and staff. Visitors with research needs are permitted to use the library's collections, providing the use does not conflict with its primary responsibility to members of the CWRU community. As a federal depository library, the Law Library is open to the public to use federal documents and online information available here.

General Use Policies

Library Access The Law Library is open seven days a week when classes are in session.  Information about the Law Library's hours and scheduled closures are available on the library hours page. Access to the Law Library is restricted throughout final exam periods.  During this time we continue to remain sensitive to the needs of the extended community, members of the public and non-law students conducting legal research, who are welcome to retrieve books or obtain research assistance.

Patrons not affiliated with Case Western Reserve University must present a photo ID at the Circulation Desk and sign the guest log before gaining access to the Law Library.  After 6 pm, external doors of the building are locked and, although the library is still open to the public, patrons must ring the bell located at the main Gund Hall Entrance on East Blvd for a security officer’s assistance to access the Law Library.

Reference Members of the public may ask for research assistance in person at the Reference Desk or via email at lawref@case.edu. We are available many, but not all hours the Law Library is open. The Reference Desk is located in front and slightly to the left as you enter the library.  Ohio Law does not allow library staff to give patrons legal advice, including interpretation of statutory or case law.  If you need legal advice, please consult an attorney.  You may find an attorney by using a directory, such as Martindale.com or Avvo.com.

Food & Beverages Foods that are usually eaten hot, can disturb others around you, emit odors, and/or are messy therefore are prohibited in the law library. Small, vending style snack food and non-alcoholic beverages in spill-proof containers with tight fitting lids, are permitted in the library with the exception of the computer labs. Patrons are required to comply with signage and staff requests where and when food and/or covered drinks can be consumed. Please consume food in a responsible manner and dispose of trash in waste and recycling containers provided.

Noise and conversation Many students use the Law Library for quiet study and reading. As a courtesy to them, please keep conversations to a minimum. The Richey Reading Room (basement) is a designated quiet zone. The First floor, where many services are offered, can be noisy.

The Library knows you "want to stay in touch," but ringing phones and loud cell phone conversations add unnecessary noise making it difficult for many people to study and work. Be considerate to others: turn off the cell phone ringer or switch to silent-vibrate mode in the library. Put the call on hold and move outside the gates to talk.

Study Rooms Third floor study rooms are for CWRU Law students only.

Circulation Policies

Borrowing Members of the CWRU community with appropriate authentication and persons with current a CWRU ID have check-out privileges. Bring the items you want to take out of the library to the Circulation Desk to be checked out.  Return books to the Circulation Desk during library hours.

Loan periods/ Fines Loan periods and fines vary depending on the status of the borrower and the type of material checked out.

Renewals You may renew books by contacting Circulation in person, by phone (216-368-2792) or by using the My Library Account found on the catalog home page. To renew books in person or by phone, you will need your CWRU ID. Materials from Course Reserve and the Reference Area cannot be renewed. These materials should be returned to the Circulation Desk

Fines Overdue Case Law Library monographs accrue fines at the rate of 0.25/day. Other fines for special loans, recalled items, etc. may apply. OhioLINK overdue fines (0.50/day for monographs) cannot be waived for any users. Interlibrary Loan Materials fines accrue at a rate of 0.50/day. For lost Case Law Library Materials, patrons will be charged $110.00 for each lost item. View a detailed fine list at [LINK to Libguide or Website Chart].

Reserves Frequently used legal materials, including nutshells, treatises, hornbooks, practice guides and other miscellaneous materials are located on the first floor of the library and to the right of the circulation desk. These items do not circulate. Only Law Faculty may check them out.  [LINK to Libguide or Website Chart].

DVD Collection The Judge Ben C. Green Law Library DVD collection is located on the first floor of the Library. Please see the circulation staff for help with this collection. A video-specific search tool is located here and allows you to limit your search to the law library. Only CWRU students, faculty and staff can check out DVDs from the law school.

Damaged Books You are responsible for any damage that occurs to an item while it is checked out to you. A book is considered “damaged” if it is returned to the library in a condition that requires extensive repair OR is unable to be repaired and cannot be returned to circulation. Examples of damaged books include, but are not limited to, those with water damage, mold, writing on the inside of the book, torn or missing pages, and/or damage to the outside of the book. Damage will be assessed by the Library Staff, who will determine if the book can be repaired. Fines will be assessed according to the severity of the damage and range from $10.00 up to the replacement cost of the book or the total repair costs if the book cannot be replaced. If you wish to check out a book that is already damaged, please show the damage to the circulation desk staff. We will make a note in the record, so as not to hold you responsible when the book is returned.

Printing Policy for Guests

The law library has 10 guest accessible computers that can print to the first floor printer/copier. These computers access web-based databases and send print jobs to a printer/copier located on the first floor of the library. Print jobs cost $.15 per page, payable with coins, $1.00 or $5.00 bills.

Printing Policy for Students

The Law School places limits on student printing in order to reduce waste and contain costs. The following policies apply to law students printing to law school owned printers.

Overview Students enrolled in the Law School receive 750 pages (black and white) of free printing for each half year (July 1 to December 31 and January 1 to June 30). The printing system calculates this balance in dollars and cents, with each page given a value of $0.05. As a result, each half year a student receives a printing allocation of $37.50. Each page printed on law school printers is deducted at $0.05 per page from this allocation. Color printing, if available, is deducted at $0.15 per page. Double-sided printing is discounted by 20% (i.e. $0.04 per page) to reflect the actual savings provided by double-sided printing.

If a student exhausts the printing allocation provided by the school, he or she is required to purchase additional pages on a secure web site in order to continue printing. More detailed procedures and instructions are available at https://lawhome.case.edu/students/papercut/. To minimize inconvenience, the system allows a student to accrue a deficit of 100 pages ($5). Once a student reaches this overdraft limit, printing is immediately cut off and is not restored until the deficit is paid and additional funds are added by means of the secure web site.

At the end of the half-year any unused funds are transferred to the new half-year and an additional $37.50 is added to the balance to a balance maximum of $75.00.

Special Circumstances A student organization, such as journals, SBA, Mock Trial, etc., can request that special shared printing accounts be created for their organization to help offset the increased printing demands of being a member of that organization. To get a special account set up, the leader of the organization should contact the Director of Information Technology, Tron Compton-Engle at tac11@case.edu. The organization's leader will be required to provide a written request which includes the number of pages desired for the organization, a detailed rationale for the number of pages (e.g. events or projects that require printing), and the names and University network IDs of all of the members of the organization. The Director will review the request and forward it to the Chair of the Library and Computers Committee for final approval. At his or her discretion, the Chair of the Library and Computers Committee can request additional information or documentation or grant fewer pages than requested.

Staff and faculty can send request to the Director of Information Technology for special accounts for students in a class with unusually high printing demands, for student workers, for research assistants, or for any other group of students that needs additional pages. The Director will review the request and forward it to the Chair of the Library and Computers Committee for final approval. Students are not eligible for printer fund increases for any other circumstances.

If you are a member of a student organization or other group or class with additional printing demands, inquire with the organization leader or supervising faculty member whether a shared account is available. The Library and Computers Committee reserves the right to determine which organizations and classes receive special accounts and the initial balances available in those accounts. It is the responsibility of each organization to manage prudently its own printing account. An organization’s balance will not be replenished due to the misuse of the shared account by one student in the organization.

Students can request that the Director of Information Technology refund print jobs for situations such as poor print-out quality, damaged print jobs, and print jobs that are charged, but don’t come out of the printer. Refunds are not provided when the issue is caused by a student’s own error (lost print-outs, printing the wrong document, etc.). When granted, refunds are provided as credits in the printing system (restoring pages to a printing balance), not as cash or credit card refunds. Unused funds in the printing system are not refunded, even in cases where the pages where purchased with a credit card. In situations where it is unclear whether a refund should be granted, the Director will consult with the Chair of the Library and Computers Committee, whose decision is final.

Penalties Students reaching their 100 page ($5) overdraft limit are immediately denied printing to law school printers. Printing is not restored until additional funds are added to the balance either by the student purchasing pages on the School’s secure credit card site or an automatic deposit of funds at the beginning of a half-year (July 1 or January 1).

If it is determined by the Information Technology Department that a student has intentionally circumvented the school’s printing system in order to avoid the limitations placed on printing described in this policy or assisted other students in doing so, he or she may have all law school computer privileges revoked, including, but not limited to printing, computer lab access and taking exams on computer, for any period of time as determined by the Associate Dean for Academic Affairs. Intentionally circumventing the printing system may also be determined to be a violation of the Law School’s Code of Conduct (Section II.4), with applicable disciplinary procedures and penalties.
